These Terms and Conditions (the "Terms") apply to the painting information pages published at texpainting.primerjobs.com — the exterior painting page, the interior painting page and the shared thank-you page — and to the estimate request form on those pages.
PrimerJobs is not a painting contractor. We do not paint houses, and we will not be painting yours. We publish these pages so that homeowners in Austin and Central Texas can read about painting services and ask an independent painting business to get in touch.
Any actual painting work is performed by Tex Painting LLC, a separate and independent business. Submitting the form asks Tex Painting LLC to contact you. It does not hire anyone, and it does not create a contract for painting work.
You agree to these Terms when you submit the estimate request form, and — if we have given you notice of a change as described in the section on changes — by continuing to use these pages after that change takes effect. Simply reading or browsing these pages is not agreement to anything.
Nothing in these Terms takes away any right you have under Texas consumer-protection law, including the Texas Deceptive Trade Practices–Consumer Protection Act. Please see the section headed "Your Texas consumer rights are preserved, and governing law".
Who operates these pages, and what we actually do
PrimerJobs is not a painting contractor. We do not paint houses, we do not employ painters, we do not supervise crews, we do not schedule or inspect jobs, we do not choose materials, and we do not set the price of any painting work. All painting is done by Tex Painting LLC, an independent business that is solely responsible for its own work, its own prices, its own promises and its own conduct.
These pages are published and operated by PrimerJobs ("PrimerJobs", "we", "us", "our"), a lead-generation and marketplace platform. Our mailing address is 1309 Coffeen Ave, Sheridan, WY 82801. You can reach us at support@primerjobs.com or +1 (650) 789-5852.
The painting services described on these pages are offered by Tex Painting LLC, an independent business at 4309 Camacho St, Austin, TX 78723. Tex Painting LLC is not owned or controlled by PrimerJobs, and PrimerJobs is not owned or controlled by Tex Painting LLC. Neither company is the other's employer, employee, agent, partner, joint venturer or representative. Neither one acts on the other's behalf. Each is responsible only for what it does itself.
Our role here is narrow and specific: we publish these pages, we receive the information you choose to enter in the form, and we pass that information to Tex Painting LLC so that it can respond to you. That is the whole of what we do on these pages.
We want to be straightforward about something a homeowner would reasonably want to know: PrimerJobs does not vet, screen, license-check, insurance-verify, certify, rank or endorse Tex Painting LLC or any other contractor. If you see the word "qualified", "trusted" or anything similar used about painting professionals in our marketing, it does not mean we have checked anything. Please do your own checking before you hire anyone — ask for proof of insurance, a written warranty and a written estimate.
Tex Painting LLC's business name, logo, photographs, reviews and service descriptions appear on these pages so you can recognise the business that would actually perform the work. Their appearance does not mean PrimerJobs owns, operates, endorses, vets, certifies or is affiliated with Tex Painting LLC.
You never pay PrimerJobs anything. Using these pages and submitting the form is free to you, and we do not collect payment card, bank or other financial details on these pages. Where PrimerJobs is paid in connection with these pages, that payment comes from Tex Painting LLC — not from you. That is a commercial relationship you are entitled to know about when you weigh what you read here.
Your agreement to these Terms
You accept these Terms by submitting the estimate request form. You also accept an updated version of these Terms by continuing to use these pages after a change takes effect, where we have given you the notice described in the section on changes.
Reading these pages, scrolling them, or clicking around them is not acceptance. If you do not agree with these Terms, do not submit the form.
These Terms are written specifically for these three painting pages. They should be read together with the general PrimerJobs Terms & Conditions and the PrimerJobs Privacy Policy published at primerjobs.com, which also apply to you and which cover the PrimerJobs platform as a whole. Where a point is specific to these painting pages and this document addresses it directly, this document is the one that describes what happens here.
The Privacy Policy for these pages explains what the form collects, who receives it, how long it is kept and what choices you have. Please read it before you submit anything.
Who may use these pages
These pages are meant for adults with a real interest in painting work. To use the form, all of the following should be true:
- You are at least 18 years old. These pages are not intended for children, and we do not knowingly accept information from anyone under 18.
- You either own the property you are asking about, or you have the owner's permission to ask for estimates and to have a contractor contact them about it.
- The contact details you enter are your own, or you have permission from the person they belong to.
- You are asking about a real property and a real painting job — not testing, scraping, or submitting information for some other purpose.
If you are submitting on someone else's behalf — a parent, a client, a tenant, an employer, a relative — you confirm that they know about it and have asked you to do it.
What submitting the form does, and what it does not do
Submitting the form does not hire anyone, and it does not confirm that your request arrived. It creates no contract for painting work with PrimerJobs or with Tex Painting LLC. The thank-you page appears as soon as your browser has sent the form — it acknowledges that you pressed submit, and nothing more.
We want to be honest about how the delivery actually works, because it affects you. When you submit the form, your browser sends your details onward. Because of the way that transmission is made, our page cannot always tell whether the message arrived at the other end. So the thank-you page is not a confirmation that your request went through, was received, or was delivered to anyone. It only tells you that the form was submitted from your browser.
If you have not heard from Tex Painting LLC within a couple of business days, please assume nothing arrived and call them directly at (737) 350-8970, or email info@texpainting.com. You can also tell us at support@primerjobs.com and we will look into it.
What submitting the form is meant to do:
- Record your request to be contacted about painting services.
- Send the information you entered onward so that Tex Painting LLC can reach out to you.
- Show you a thank-you page acknowledging that you submitted the form.
What submitting the form does not do:
- It does not book a job, reserve a crew, hold a date, or start any work.
- It does not lock in a price, a price range, a start date or a completion date.
- It does not obligate Tex Painting LLC to contact you, to visit your property, to quote your job, or to take your job at all.
- It does not obligate you to buy anything or to accept any estimate you are given.
- It does not make PrimerJobs a party to any painting contract you may later sign.
- It does not guarantee that your request reached anyone.
A painting job only becomes real when you and Tex Painting LLC agree, in writing and directly with each other, on a written estimate or contract. Everything before that point is a conversation.
What the form collects and where it goes
The estimate form asks you for:
- Your full name.
- Your phone number.
- Your email address.
- The type of job (interior, exterior, kitchen cabinets, commercial, or other).
- Your timeline.
- The exterior areas, or the rooms, you want painted.
- Your ZIP code.
The form does not ask for a street or property address. It asks only for your ZIP code. If you type an address into a free-text box anyway, it comes to us as part of what you wrote, but we do not request it and you do not need to provide it.
The form does not collect payment card, bank account or other financial information, and it does not ask for a Social Security number, driver's licence number or date of birth. If anyone contacts you claiming to be PrimerJobs and asks for those details or for payment for an estimate, do not give them anything — please tell us at support@primerjobs.com.
Along with your answers, the submission carries a small amount of technical information: the web address of the page you submitted from, the date and time of submission, and the name of the advertised offer shown on that page ("Get $500 of FREE Paint"). The form also contains a hidden anti-spam field that is not meant for you to fill in.
A copy of your answers is also saved in your own browser's session storage, under the name "texLead", so that the thank-you page can greet you by your first name. That copy stays on your device until you close the tab. It is not used for tracking or advertising.
Where your information goes:
- To Tex Painting LLC, so it can contact you about your request. This is the whole point of the form, and it is what you are asking us to do when you submit it.
- To service providers that work for us — the provider that hosts these pages, and the provider that receives form submissions. A Google-hosted spreadsheet service is intended to receive submissions. These providers process the information on our behalf, and they are not permitted by us to use it for their own marketing.
- To legal or government authorities, where the law requires it or where we reasonably believe it is necessary to protect someone's safety or our legal rights.
- To an acquirer, if PrimerJobs is involved in a sale, merger or reorganisation. Any acquirer would be bound by commitments no less protective than these.
We do not sell your information to lead brokers, data brokers, list sellers or other painting companies, and we do not hand it to advertising networks from these pages.
There is one nuance we would rather explain than hide. Some state privacy laws define "sale" and "share" broadly. If PrimerJobs receives compensation from Tex Painting LLC in connection with a referral, a regulator could treat that transfer of your details as a "sale" or a "share" under those laws, even though no data broker is involved and even though it is the transfer you asked us to make. Because of that, we offer you an opt-out: email support@primerjobs.com with "Opt out of sale/share" in the subject line and we will honour it.
Using that opt-out does not cut you off from the service. If you have already asked us to pass your request to Tex Painting LLC, we can still carry out the transfer you directed us to make, without treating it as a compensated one. We will not refuse you service, charge you a different price, or treat you differently because you exercised a privacy right.
Your information may be processed in the United States, Canada and India, which is where PrimerJobs personnel and vendors operate, as described in the main PrimerJobs Privacy Policy. Privacy laws in those countries are not identical to one another.
Calls, texts and email — permission, and how to stop them
Agreeing to calls or texts is never a condition of buying anything. You do not have to agree to automated calls or texts to get an estimate, to use these pages, or to be contacted. If a form on these pages ever presents a consent checkbox, you can leave it unticked and still ask for an estimate.
When you submit the form, you are asking to be contacted about your painting request. PrimerJobs and Tex Painting LLC may each reach you by phone call, text message or email at the details you gave — including at a mobile number — in order to respond to your request, arrange an estimate, and follow up about it. Each company contacts you on its own behalf, for its own purposes. Neither is calling as the other one's agent.
Where the form presents a consent disclosure about automated calls and texts and you submit the form with that disclosure, your submission is your prior express written consent for the party or parties named in that disclosure to contact you at the number you provided. Where the form does not present such a disclosure, no such consent has been given, and outreach must be limited to what the law permits without it. We are not asserting that you have already given consent you were never asked for.
If a consent disclosure is presented, here is what it means in plain language — and these points apply to any automated outreach either company makes:
- Who may contact you: PrimerJobs and Tex Painting LLC, each on its own behalf, at the phone number and email address you entered.
- Calls and texts may be made using an automatic telephone dialing system, and may use a prerecorded or artificial voice.
- Consent is not a condition of purchase. You are not required to agree to automated calls or texts in order to buy anything, get an estimate, or use these pages.
- Message frequency varies — it depends on your request and on how the conversation goes.
- Message and data rates may apply, depending on your mobile plan.
- Reply STOP to any text to stop texts. Reply HELP to any text for help.
- You can revoke your permission at any time, by any reasonable means.
How to stop contact. You can tell us to stop by any reasonable method, and you do not have to use any particular wording. Replying STOP, QUIT, END, CANCEL, REVOKE, OPT OUT or UNSUBSCRIBE to a text works. So does saying "stop calling me" to whoever is on the phone, clicking the unsubscribe link in an email, emailing support@primerjobs.com, or calling us at +1 (650) 789-5852. To tell Tex Painting LLC directly, email info@texpainting.com or call (737) 350-8970.
A request received on one channel counts across all of them. If you tell us to stop by text, we treat that as stopping automated calls and texts from us generally — you do not have to send a separate request for each channel. We will act on a revocation as soon as practicable and in any case within 10 business days of receiving it.
PrimerJobs and Tex Painting LLC are separate companies with separate systems. If you send a stop request to us, we will pass it on to Tex Painting LLC; if you send it to them, ask them to pass it to us. If you want to be certain contact stops quickly from both, the safest course is to tell both — but you should not have to chase it, and if contact continues after you have told either company to stop, please tell us at support@primerjobs.com.
Federal law — including the Telephone Consumer Protection Act and the CAN-SPAM Act — and Texas law give you rights about telemarketing calls, texts and commercial email. Nothing in these Terms limits those rights, and nothing here should be read as consent to any call, text or email that those laws do not permit.
Complying with do-not-call and telemarketing rules for our own outreach is our responsibility, and complying for its outreach is Tex Painting LLC's responsibility. That duty is not yours, and these Terms do not shift it to you.
What you are confirming when you submit the form
When you submit the form, you are telling us that:
- The information is true, accurate and current, to the best of your knowledge.
- You are not using a false name, a decoy identity or a misdirected number to mislead anyone.
- If you are entering someone else's contact details, that person asked you to do it, or has given you permission to give their details for this purpose.
- If you are entering someone else's contact details, you are not entering the details of a person who has told you they do not want to be contacted about home services, or whose number you know is registered on a do-not-call list for that purpose.
- You understand your information will be passed to Tex Painting LLC so it can respond to your request, and you are asking us to do that.
- You are filling in the form yourself, not through a script, bot or automated tool.
To be completely clear: the do-not-call point above applies only to entering somebody else's details. Giving us your own phone number never breaches these Terms, even if your number is on the National Do Not Call Registry or the Texas No-Call List. You are entitled to be on those lists and to ask a business for an estimate, and nothing here makes that a problem for you.
Giving us another person's contact details without their permission can cause real trouble for that person and can break the law. Please don't.
Advertising and tracking on these pages
This statement is about these pages only — the exterior painting page, the interior painting page, the thank-you page and these legal pages at texpainting.primerjobs.com.
These pages load Google Tag Manager, which in turn loads Google Analytics 4 and Google Ads conversion tracking. These tools set cookies and similar identifiers in your browser and receive your IP address, device and browser type, the pages you view and how you interact with the form. We use them to measure how our advertising performs — for example, how many people who clicked an ad went on to request an estimate.
If you arrive from a Google ad, the web address may carry a click identifier (gclid) and campaign tags such as utm_source. We store these in your browser for up to 90 days and attach them to your request so we can tell which advertising produced it.
We keep your personal details out of those advertising and analytics tools. Your name, phone number, email address and ZIP code go to our lead records only. What Google Analytics and Google Ads receive is limited to the fact that a step was completed, which service page it happened on, and a random reference code for the request — never your contact details.
These pages also load a styling framework from a public code delivery network, and the founder video is served from texpainting.com. Loading those files sends your IP address and browser type to those providers, as happens on most websites. Neither of them is given your form answers.
Under Texas law some of this activity counts as targeted advertising, and you have the right to opt out of it. The Privacy Policy for these pages explains how, and what happens when your browser sends a recognised opt-out signal.
The wider PrimerJobs platform is a different matter. primerjobs.com itself is governed by the general PrimerJobs Privacy Policy, which permits practices beyond those described here. If you go on to use primerjobs.com, that policy — not this statement — describes what happens there.
If we change the measurement or advertising technology on these pages, we will update this section and the Privacy Policy for these pages before the change goes live.
Prices, ranges, timelines and estimates shown on these pages
Any price, price range, sample cost, "starting at" figure, scheduling window, turnaround time or project duration shown anywhere on these pages is illustrative only. It is there to give you a rough sense of what a job like yours might involve. It is not a quote, not an offer, and not binding on PrimerJobs, on Tex Painting LLC, or on you.
Real painting prices depend on things a web page cannot see: the size and condition of the surfaces, how much preparation and repair is needed, access and height, the number of colours and coats, the products chosen, the season, and how much work the contractor already has booked.
The only number that means anything is a written estimate that Tex Painting LLC gives you after assessing your property. Until you and Tex Painting LLC have agreed to that written estimate, nothing about price, scope or timing is fixed.
PrimerJobs does not set, approve, negotiate, discount or guarantee the price of any painting work. If a figure you saw on these pages does not match the estimate you receive, the estimate is the real number, and any discussion about it is between you and Tex Painting LLC.
The "$500 of free paint" offer
These pages advertise an offer of $500 of free paint. Here is what we can honestly tell you about it.
- Eligibility and the full terms of the offer are set and confirmed by Tex Painting LLC. PrimerJobs does not decide whether you qualify and cannot award, enforce or overrule the offer.
- The offer applies only to qualifying jobs. Whether your job qualifies is normally decided after Tex Painting LLC has assessed your property and prepared a written estimate — not when you submit the form.
- Tex Painting LLC will provide the offer's full terms to you in writing before any painting work is agreed. Ask for them, and read them, before you sign anything. Those terms should tell you what counts as a qualifying job, any minimum job size, which products are included, whether the offer can be combined with anything else, and any expiry date.
- Submitting the form does not by itself earn, reserve or entitle you to the offer.
- The offer may be changed, limited, paused or withdrawn at any time before you and Tex Painting LLC agree to a written estimate. If it is withdrawn or does not apply to your job, you are under no obligation to go ahead with anything.
We are deliberately not stating who funds the offer, how it is redeemed, whether it has a cash value or how many are allowed per household, because those are Tex Painting LLC's terms to set and confirm in writing, and we will not put figures in your head that we have not verified.
If you and Tex Painting LLC disagree about whether the offer applies to your job, that is a matter between the two of you. You are welcome to tell us about a problem at support@primerjobs.com and we can pass it on.
Warranties, insurance and other claims about the painting work
Any warranty, guarantee, satisfaction promise, insurance coverage, years-in-business claim, review rating, ranking or workmanship claim shown on these pages describes Tex Painting LLC's own business and is made by Tex Painting LLC. PrimerJobs does not verify, adopt, underwrite or stand behind those claims.
PrimerJobs gives no warranty of any kind on painting work. Not on workmanship, not on materials, not on colour or finish, not on cleanliness, not on scheduling, not on how long the paint lasts, and not on how anyone behaves at your property.
If painting work is defective, unfinished, delayed, or damages your property, your claim is against Tex Painting LLC under whatever agreement and warranty you have with them.
Before you sign anything, ask Tex Painting LLC for the written workmanship warranty, current proof of insurance, and the complete written estimate — and read all three. Marketing copy on a web page is not a contract. The documents the contractor hands you are.
If your home was built before 1978, ask Tex Painting LLC for their EPA Lead-Safe Certified Firm number and for the EPA's "Renovate Right" pamphlet before any work that disturbs paint begins. Much of the Austin and Central Texas housing stock predates 1978, and federal rules apply to that work.
Acceptable use
Please use these pages the way they are meant to be used. You agree not to:
- Submit false, fake, stolen or someone else's personal information without their permission.
- Submit the form using bots, scripts, macros, automated form-fillers or any other automated means.
- Interfere with or attempt to defeat the anti-spam measures on these pages, including the hidden field that helps us screen out automated submissions.
- Scrape, harvest, crawl, mirror or bulk-copy the pages or any information on them, except by ordinary search-engine crawling that we permit.
- Probe, scan, overload or attempt to gain unauthorised access to the pages, the form, or any system behind them.
- Upload or transmit anything harmful — malware, malicious code, or content designed to disrupt the pages.
- Use the pages to send unsolicited marketing, to harass anyone, or to break any law.
- Copy the pages to create a competing site, or present our content as your own.
- Impersonate PrimerJobs, Tex Painting LLC, or any other person or business.
We may block, filter or discard any submission we reasonably believe is automated, fraudulent, abusive, or made without the permission of the person whose details it contains. Because we do that, and because of the delivery limitation described earlier, a submission that looks fine to you may still not reach anyone. If you do not hear back, please call Tex Painting LLC at (737) 350-8970 rather than waiting.
Intellectual property
The design, layout, code, written copy, graphics, illustrations and arrangement of these pages are owned by PrimerJobs or licensed to us, and are protected by copyright and other laws.
The Tex Painting name, logo and brand belong to Tex Painting LLC. They appear here to identify the independent business that would perform the work, and for no other purpose.
We give you a limited, personal, revocable, non-exclusive permission to view these pages and to print or save a copy for your own use while you are considering painting work. That is all it covers.
You may not copy, republish, sell, license, frame, mirror, adapt or create derivative works from these pages or their content, or remove any copyright or ownership notice, without our written permission.
If you believe something on these pages infringes your copyright or trademark, please write to support@primerjobs.com with enough detail for us to find it and we will look into it.
Links and third-party services
These pages rely on a small number of services run by other companies — the provider that hosts the pages, a public code delivery network that supplies styling code, a spreadsheet service intended to receive form submissions, and the website of Tex Painting LLC, which hosts the video shown on these pages. These pages may also link out to Tex Painting LLC's own website.
We do not control those services and are not responsible for their content, their accuracy, their availability, their security or how they handle information. Their own terms and privacy policies apply when you use them.
A link is not an endorsement, a recommendation, or a statement that we have checked what is on the other end of it. Please use your own judgement, particularly before entering personal or financial information anywhere other than these pages.
Disclaimer of warranties
These pages and the form are provided "as is" and "as available", with all faults. To the fullest extent the law allows, PrimerJobs disclaims all warranties of every kind, whether express, implied or statutory — including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.
In particular, we do not promise that:
- The pages will be available without interruption, error, delay or security incident.
- Information on the pages — including anything about services, prices, ranges, timelines, warranties or offers — is complete, accurate or current at the moment you read it.
- Your submission will reach Tex Painting LLC, or will reach them within any particular time. As explained earlier, our page cannot always tell whether the message arrived.
- Tex Painting LLC will contact you, will be available in your area, will quote your job, will take your job, or will offer any particular price or schedule.
- Any painting work will meet your expectations, or that the promotional offer will apply to you.
Some laws do not allow certain warranties to be excluded. Where that is the case, these exclusions apply only to the extent the law permits, and you keep rights this section cannot take away — including your rights under the Texas Deceptive Trade Practices–Consumer Protection Act.
Limitation of liability — please read this section
IMPORTANT — THIS SECTION LIMITS WHAT YOU CAN RECOVER FROM PRIMERJOBS, INCLUDING FOR OUR OWN NEGLIGENCE. To the fullest extent the law allows, PrimerJobs' total liability to you for all claims relating to these pages, taken together, is limited to the greater of (a) the amount you paid PrimerJobs in the twelve months before the claim arose, or (b) one hundred US dollars (US$100). Since we do not charge homeowners for these pages, that figure will normally be US$100. Several important categories of claim are carved out of this limit — they are listed immediately below, and they are not limited by this section.
This limit does NOT apply to, and nothing in these Terms waives, limits or caps:
- Any right or remedy you have under the Texas Deceptive Trade Practices–Consumer Protection Act, or under any other Texas or federal consumer-protection law that cannot be limited or waived by agreement.
- Any claim for death or personal injury caused by our negligence.
- Any claim arising from our fraud, fraudulent misrepresentation, gross negligence or wilful misconduct.
- Any claim under the Telephone Consumer Protection Act or other statutory claim whose remedies cannot be limited by contract.
- Anything else the law does not permit us to limit.
Subject to those carve-outs, and to the fullest extent the law allows, PrimerJobs and its owners, officers, employees, contractors and suppliers will not be liable to you for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost savings, lost data, lost opportunities or damage to reputation, arising out of or relating to these pages, the form, or your dealings with Tex Painting LLC — even if we were told such damages were possible.
This includes any loss, property damage, personal injury, cost or delay caused by painting work performed or not performed by Tex Painting LLC. We are not the contractor, and we do not carry the contractor's risk. Your claim about the work is against Tex Painting LLC.
These limits are a basic part of the arrangement between us, and they apply even if a remedy in these Terms is found to have failed its essential purpose.
Indemnification
This section is limited to claims brought against us by someone else. It does not apply to any claim you bring against us, and it does not stop you from complaining about us or suing us.
If a third party brings a claim, demand or proceeding against PrimerJobs or its owners, officers, employees or contractors, you agree to defend and indemnify us against that third-party claim and reasonable legal costs, to the extent the claim arises out of:
- Contact details or other personal information you submitted that belonged to someone else and were submitted without that person's permission.
- Information you knowingly submitted that was false.
- Your breach of these Terms.
- Your violation of any law, or of anyone else's rights.
- Your misuse of these pages, as described in the acceptable use section.
This section does not apply — and you owe us nothing under it — to the extent a claim arises out of PrimerJobs' own acts, omissions or negligence, or out of Tex Painting LLC's own acts, omissions or negligence. That includes any claim about how either company called, texted or emailed anyone, since do-not-call and telemarketing compliance for our own outreach is ours to get right, not yours.
Submitting your own contact details — including your own phone number, whatever lists it appears on — never triggers this section.
We will tell you promptly about any claim we want covered. You may not settle it in a way that admits fault on our behalf or imposes an obligation on us without our written agreement, and we may take over the defence of a claim at our own cost if we choose to.
If we have a disagreement
Start by talking to us. Most problems are resolved fastest by email. Before starting any formal proceeding, please write to support@primerjobs.com describing what happened and what you would like us to do, and give us 30 days to work it out with you. We will do the same before starting anything against you.
Dispute resolution between you and PrimerJobs is governed by the dispute-resolution section of the general PrimerJobs Terms & Conditions published at primerjobs.com, which is incorporated into these Terms by reference. We are not writing a second, different arbitration clause here, because two versions that disagree would help nobody. In summary, and so you know what you are looking at before you open it: that section provides for binding individual arbitration of disputes instead of court, and it includes a class-action waiver, meaning claims must be brought individually rather than as part of a class or representative action. Please read that section in full.
Additional protections that apply on these pages. The following are extra rights we give you here. They add to the master terms and, where they differ from them, the more protective reading applies to disputes about these pages.
- You have 30 days to opt out of arbitration and the class-action waiver. The 30 days run from the date you submit the estimate request form on these pages. The clock does not start when you read a page, browse a page, or click around — only when you submit the form.
- To opt out, email arbitration-optout@primerjobs.com (copy support@primerjobs.com) with "Arbitration Opt-Out" in the subject line, your name, and the email address or phone number you used on the form. That is all it takes.
- Opting out is free. It takes effect as soon as we receive it. It will not affect whether Tex Painting LLC contacts you, what estimate you are given, or your eligibility for any promotional offer.
- If you opt out, disputes between you and PrimerJobs are decided by the courts described in the governing law section below.
- Either of us may bring an individual claim in small claims court if it qualifies there, and either of us may ask a court for an injunction to stop misuse of intellectual property or unauthorised access to our systems.
- Nothing in these Terms or in the master dispute-resolution section prevents you from reporting a concern to the Texas Attorney General, the Federal Trade Commission, the Federal Communications Commission, the Better Business Bureau, or any other government agency, or from taking part in an action brought by such an agency.
Disputes with the contractor are separate. This section governs disputes between you and PrimerJobs only. Any dispute with Tex Painting LLC about the work, the price, the schedule, the warranty or the paint offer is governed by whatever agreement you have with Tex Painting LLC — not by PrimerJobs' terms. Tex Painting LLC is not a party to these Terms, and PrimerJobs cannot arbitrate, mediate or decide a dispute between you and them.
Your Texas consumer rights are preserved, and governing law
READ THIS BEFORE THE GOVERNING LAW SENTENCE BELOW. Nothing in these Terms waives, limits or reduces any right or remedy you have under the Texas Deceptive Trade Practices–Consumer Protection Act (Tex. Bus. & Com. Code ch. 17, subch. E) or under any other Texas consumer-protection law that cannot be waived. Those rights apply to you regardless of the choice of law stated below, and any attempted waiver of them would be void. If you are a Texas resident, you keep every DTPA right you would otherwise have, including the right to bring a DTPA claim and to recover the remedies that Act provides.
Subject entirely to the paragraph above, these Terms and any dispute arising out of them or out of these pages are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. We use Wyoming law for consistency with the general PrimerJobs Terms & Conditions, not to move you out of reach of Texas law.
This choice of law does not take away protections that the law of your home state gives you and does not let you give up. For Texas residents that includes the Texas Deceptive Trade Practices–Consumer Protection Act and your privacy rights under the Texas Data Privacy and Security Act. Where a non-waivable protection under your home state's law conflicts with anything in these Terms, that protection wins.
If a dispute is not subject to arbitration — because you opted out, because it falls within an exception, or because arbitration is found not to apply — it may be brought either in the courts of the state where you live or in the state or federal courts located in Wyoming. Each of us consents to those courts having jurisdiction. Nothing here requires a Texas resident to travel to Wyoming to bring a claim.
Deleting your information
You can ask us to delete the information you submitted. Email support@primerjobs.com from the address you used, or call +1 (650) 789-5852, and tell us what you want deleted. We do not charge for this.
We will delete the copy we hold, and we will pass your deletion request on to Tex Painting LLC.
We should be honest about the limit of what we can do. Once your request has reached Tex Painting LLC, they hold their own copy as an independent business, and they decide what happens to their records. We can ask; we cannot delete their files for them. We may need to keep a minimal record of your deletion request itself, so we can show that we honoured it, and we may keep information the law requires us to keep.
The Privacy Policy for these pages describes how to make access, correction and deletion requests, how long information is kept, and how quickly we respond.
Suspension and termination
You can stop using these pages at any time; simply close them.
We may change, suspend, restrict or discontinue the availability of these pages or the form at any time — for example if they are being misused, if a submission looks automated or fraudulent, or if we stop running these pages altogether. That right is about the availability of the pages. It is not a right to change these Terms without notice; changes to these Terms follow the section below.
Ending your use of the pages does not undo a form you already submitted. If you no longer want to be contacted, use the stop methods described earlier. If you want your information deleted, see the section on deleting your information.
The sections that by their nature should outlast your use of the pages — intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, Texas rights preservation and governing law — continue to apply afterwards.
Changes to these Terms
We may update these Terms from time to time — for example if the pages change, if the offer changes, or if the law changes. The current version and its effective date are always shown at the top of this page.
Changes take effect prospectively only. An amendment never applies to a claim or dispute that had already arisen before the amendment took effect, and it never reaches back to change your rights about a form you had already submitted before the change.
If we make a change that materially affects your rights, we will give at least 30 days' notice before it takes effect, and we will make the notice reasonably prominent rather than burying it. Where we have your email address because you submitted a form within the previous 12 months, we will also email you about a material change.
Continuing to use these pages, or submitting a new form, after a material change has taken effect means you accept the updated Terms. If you do not accept a change, stop using the pages before it takes effect — and any claim you already had is unaffected either way.
If a change affects the dispute-resolution arrangements, the 30-day opt-out described above runs afresh from the date you next submit the form, and we will say so in the notice.
Other things worth stating
- If any part of these Terms is found invalid or unenforceable, that part is limited or removed to the minimum extent needed, and the rest stays in force.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your rights or obligations under these Terms to anyone else. We may transfer ours to a successor in connection with a merger, acquisition or sale of assets. If we do, your rights under these Terms and any claim you already have are unchanged, and the successor takes them on as they stand.
- Section headings are there to help you find things; they do not change the meaning of what follows them.
- These Terms, together with the general PrimerJobs Terms & Conditions and the Privacy Policy for these pages, describe the whole agreement between you and PrimerJobs about these pages. Nothing in that sentence disclaims your reliance on statements made on these pages, and nothing in it limits any claim for fraud or misrepresentation or any claim under the Texas Deceptive Trade Practices–Consumer Protection Act.
- Tex Painting LLC is not a party to these Terms. These Terms do not give third parties rights to enforce them, except that the disclaimers and the liability limits also protect our owners, officers, employees, contractors and suppliers.
- Nothing in these Terms makes PrimerJobs and Tex Painting LLC partners, joint venturers, employer and employee, or agent and principal of one another. Neither acts on the other's behalf.
